Please read these Terms of Service (“Terms”) carefully before using the PassionTrack mobile application (the “App”), operated by PrairieStone AppWorks (“we,” “our,” or “us”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Description of Service
PassionTrack is a motion-based session counter that uses device motion sensors to detect movement during a session. The App may be used while the phone is secured to an arm, leg, waist, or held in the hand. The App records session history, motion counts, session date and time, duration, sensitivity or calibration settings, and app preferences on the device. Some data is generated automatically by the App from device sensors, while other data may be user-selected or configured in the App.
2. Your Content
Session data, motion counts, history, preferences, and settings created or generated by the App remain your data and are intended to be stored locally on your device. We do not operate a PassionTrack cloud account or cloud sync service, and we do not have access to your stored session or motion data through a PrairieStone server.
3. In-App Purchases
The App may offer a Monthly subscription, a Yearly subscription, and a Lifetime one-time purchase. All purchases and subscriptions are processed through Google Play. Subscriptions automatically renew unless cancelled by the user through Google Play. Users may manage or cancel subscriptions in Google Play settings. Cancellation normally stops future renewals and access continues through the already-paid period where applicable. Access may end if a subscription expires, is cancelled after the paid period, refunded, revoked, or otherwise no longer grants entitlement. Subscription plans may include a 3-day free trial for eligible users, as determined by Google Play. Trials are not guaranteed for every account. Unless cancelled before the trial ends in accordance with Google Play terms, a trial may convert into a paid renewing subscription. A Lifetime purchase is a one-time purchase; it is not a subscription, it does not renew, and it grants permanent entitlement to the Lifetime access offered through the App subject to these Terms, applicable platform rules, refunds, revocations, account or platform availability, and continued app or platform support.
4. Disclaimer of Warranties
The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to accuracy, reliability, or fitness for a particular purpose. Motion detection and session counts are not guaranteed to be perfect. Calibration, sensitivity settings, device placement, motion characteristics, and environmental conditions can affect counting accuracy. Do not use the App in unsafe circumstances or while performing any activity that requires your full attention, and secure the phone properly before use. We do not guarantee the App will be error-free or uninterrupted.
5. Limitation of Liability
To the maximum extent permitted by law, PrairieStone AppWorks shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data or loss of use, arising from your use of the App.
6. Changes to the App or These Terms
We may update the App or these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms. Material changes will be reflected by an updated “Last updated” date above.
7. Governing Law
These Terms are governed by the laws of Saskatchewan, Canada, without regard to conflict of law principles.
