Please read these Terms of Service ("Terms") carefully before using the Drag Race Dashcam mobile application (the "App"), operated by Prairiestone Appworks ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Description of Service
Drag Race Dashcam is a personal video recording and performance-tracking application intended for recreational and informational use during drag racing or similar timed driving activities. The App records video and provides estimated reaction time, elapsed time, and related performance statistics based on your device's camera, microphone (when enabled), and location sensors.
2. IMPORTANT: Not a Safety Device
The App is not a safety device, driver-assistance system, or collision-avoidance tool of any kind. It is not designed, tested, certified, or intended to prevent accidents, injury, or property damage, and it must never be relied upon for that purpose.
Specifically:
- Foul and red-light detection is for informational purposes only. It is based on phone sensor data and may be inaccurate, delayed, or fail entirely due to sensor limitations, phone performance, vibration, lighting, or other environmental conditions. It must never be used as the official or sole determination of a foul, false start, or race outcome, and must never be relied upon in place of proper track officiating or safety equipment. Official timing equipment, timing slips, and track officials control official race results.
- Reaction time, elapsed time, and all other statistics are estimates, not certified or precise measurements, and may contain errors.
- The App is not intended to be interacted with while your vehicle is in motion. Set up recording before you begin any run, and do not attempt to view, adjust, or interact with the App while driving.
- The App does not guarantee that a recording will successfully start, continue, be saved, or remain accessible. Recording may be interrupted or unavailable due to insufficient storage, low battery, overheating, device or software failures, permission changes, operating-system interruptions, or other circumstances outside our control.
- You are responsible for securing your device so its placement does not obstruct your view, interfere with vehicle controls or airbags, or otherwise create a hazard, and for following your mount manufacturer's instructions and any venue requirements regarding device placement.
3. Lawful Use Only
The App is intended for use during racing or performance-driving activities conducted in compliance with all applicable laws — for example, at sanctioned events, drag strips, or other legally permitted venues. You agree not to use the App to facilitate, document, or time racing on public roads or any other illegal driving activity. Prairiestone Appworks does not condone, encourage, or endorse illegal racing of any kind, and reserves the right to refuse support or terminate access if we become aware, through user reports or other means, that the App is being used for illegal purposes.
4. Assumption of Risk
Drag racing and similar high-speed driving activities carry inherent and significant risks, including but not limited to serious injury, death, and property damage. By using the App, you acknowledge and agree that:
- You participate in any racing or driving activity entirely at your own risk.
- You are solely responsible for operating your vehicle safely and in compliance with all applicable laws, track rules, and safety requirements.
- You will not use the App, or allow its use, in any way that distracts from safe vehicle operation.
- Prairiestone Appworks is not responsible for your conduct, your vehicle, or the outcome of any racing activity.
5. No Liability for Injury or Damage
To the maximum extent permitted by law, Prairiestone Appworks and its developers shall not be liable for any injury, death, vehicle damage, property damage, or other loss arising from or related to your use of the App, your participation in racing activities, or your reliance on any information, statistic, or detection result provided by the App.
6. In-App Purchases
The App offers a free trial period, after which a one-time payment unlocks full functionality. All purchases are processed through the Google Play Store's billing system and are subject to Google Play's own terms and refund policies. We do not directly process or store your payment information.
7. Your Content
Videos and statistics you record remain your own property and are stored locally on your device. We do not have access to this content. If you choose to share a video using the App's built-in share feature, you are solely responsible for how and where that content is shared afterward. If you enable audio recording, you are solely responsible for complying with all applicable laws regarding the recording of other people's conversations, including obtaining any required consent from passengers or others who may be recorded — some jurisdictions require the consent of everyone being recorded, not just your own.
8. Disclaimer of Warranties
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to accuracy, reliability, or fitness for a particular purpose. We do not guarantee the App will be error-free, uninterrupted, or free of bugs.
9. Limitation of Liability
To the maximum extent permitted by law, Prairiestone Appworks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, loss of data, or loss of use, arising from your use of the App. In no event shall Prairiestone Appworks' total liability arising out of or related to these Terms or the App exceed the total amount you paid, if any, to Prairiestone Appworks for the App.
10. Indemnification
You agree to indemnify, defend, and hold harmless Prairiestone Appworks and its developers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any applicable law, including through unlawful use of the App; or (c) your violation of the rights of any third party.
11. Minimum Age
The App is intended for use by individuals who are at least 18 years old, or the age of majority in their jurisdiction, whichever is greater. By using the App, you represent that you meet this requirement.
12. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
13. Changes to the App or These Terms
We may update the App or these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms. Material changes will be reflected by an updated "Last updated" date above.
14. Governing Law
These Terms are governed by the laws of Saskatchewan, Canada, without regard to conflict of law principles.
